I worked for a construction inspection company from 2000 to 2008 as a soils specialist. I had a work related accident a few years ago. My back started bothering me. I did see a doctor at that time but was more interested in milking my insurance rather than get to the cause of my problem. He did find a tumor and operated to remove it. Insurance covered some but not all. Leaving me with a considerable bill. I paid that off. But, my back still bothered me. Fall of 2007, my arm started to become numb. I saw a different doctor who diagnosed degenerative disk disease. I was sent to a neurologist, who recommended and scheduled surgery. He did not understand the physical nature of my position and indicated I would return to work in a few months.The surgery was expensive and my insurance company paid half of it. Leaving me with  The company I worked for, eventually officially fired me, as I couldn't return to my former duties and had no other position available. I have not been able to secure full-time work and part-time work has been scarce. I have paid as much as I could toward my bills. But, money goes so far. I have worked partime jobs, emptied my 401k, borrowed, sold everything I could.

I have debts going to collection, lost friends and soon to be evicted from my house.

I have an ad up offering myself for odd jobs.

Fight Back! It’s Time YOU know the LAW about Dealing with Creditor

It has been written in several articles and books that you as a consumer have rights as much as creditors do. But what happens is that they want you to stay stupid. The more stupid you are the more they the creditor will win.

 

So You Must and Need to be smart about creditors and YOU need to know your rights. Everyone in the USA is having some type of credit problem. Even tho there are those who pay there bills on time and those who don’t or can’t, affects everyone. So we are all hurting one way or the other.

 

Now, because of your situation and your problem, no matter what happen, YOU Still have rights. Don’t let anyone else tell you otherwise. But YOU are the only one who can correct your problem.

 

After you have figure what went wrong and you have a plan. There are some laws that protect you, no matter what. Now from state to state, lots of the laws do work the same but in some states, they don’t. So check with your attorney generals website. They have a lot of good information about consumer rights.

 

Be smart and work hard to get it right. You can do it. But here are some tips that will help put your mind at ease until you can get things going again.

 

Under a law that was passed called the Fair Debt Collection Practices Act, debt collectors MAY NOT:

 

Contact you earlier than 8:00 a.m. or later than 8:00 p.m.

Contact you by phone after you have requested in writing that they stop.

Contact you at work despite their knowledge of your employer’s disapproval.

Tell people, like your boss or family members, that you owe money.

Tell you that they will take your wages.

Tell you that they will sue you. (Only your creditors can sue you.)

Send you papers that look like court papers.

Talk to you anyone but you. (They are not supposed to talk to your kids.)

They are not to scream or yell at you or cuss you out, in no way or no how.

 

That is unfair practices and should not be tolerated. You have every right as a consumer to these rights and more Fair Debt can be found in Federal level websites.

 

So if you encounter any of the acts, report the collecting company to your state general attorney’s office. In a calm and cool state, get a name, company name and address. By LAW when you request this information, they HAVE to give you this information, when requested.

 

So know your RIGHTS and stay calm and relax. You have rights as much as they do. So use them to the fullest.

I am a 25 year old woman, with a 3 year old son. I've been in school for the last year and now working in an internship that doesn't offer much pay and no benefits. I have collected all of my medical bills (and my son's) from the last year and it totals more than $1,000 and I need help paying it. I can barely stay afloat with the little money I make - I have collections agencies calling me daily. And one of them even calls anywhere from 2-4 times daily and I can't stand being in this situation. I just need help getting out of this debt. When I graduate in June, I'll be able to go get a REAL job making good money and with benefits and my son and I won't have to be uninsured anymore. So there is a solution on the horizon. I just need help now to get through this. I wanted to apply for a credit card to pay them all off and then concentrate on paying off the credit card, but my credit rating is AWFUL and I can't get approved for a card nor a consolidation loan. And I've already talked to my local county assistance program and they won't help me.

First of all they CANNOT take your SSD - NOR can they THREATEN To take it either! What they are doing is ILLEGAL. I don't care if they are from the VA or Timbuktu - you have rights. The next time they try that crap take their name, number and any other info you can get and call the state atty general and blow them in. You are protected BY LAW not only as a VET, but also as a citizen, and you are covered by the Social Security Act, the Fair debt collection practice act (FDCPA) and Mental Health laws. I am including some links for organizations that may help advocate for you.
